Teacher With HIV Had Sex With Student, Knowingly Exposed Him To AIDS Virus: Police

A Louisiana high school teacher is accused of having sex with a male student and intentionally exposing him to HIV, the virus that causes AIDS.

Derrick Nesby, 37, has been charged with felony carnal knowledge of a juvenile and felony intentional exposure to the AIDS virus, according to the Terrebone Parish Sheriff's Office. Nesby was arrested last week on suspicion of sex crimes against the victim, a 16-year-old boy, and authorities added the intentional exposure charge Friday.

Police said the victim is a student at H.L. Bourgeois High School, where Nesby taught, and the accused teacher was also the boy's track coach, according to WDSU.

An investigation was launched after a school resource officer learned of allegedly inappropriate conduct between Nesby and the student.

Nesby denied the allegations but police were able to come up with sufficient evidence for an arrest warrant. He was arrested at the school May 28. During the course of the investigation, police learned that the suspect is HIV positive, according to WWLTV.

"We can establish the fact that there was an encounter that happened," Malcolm Wolfe, Terrebonne Parish Sheriff's Chief of Detectives, told the station. Police said the incident occurred sometime last year, and that the boy did not know that Nesby was HIV positive.

WGNO reports that Nesby no longer works at the school. He was initially held on $500,000 bond, but a judge increased the amount to $1,000,000 after the additional charge was added on Friday.

If convicted, Nesby could face up to 10 years in prison on each count, a legal expert told WWLTV.
