Are The Paparazzi To Blame For Dina Lohan's DUI Arrest?

Dina Lohan appeared in court yesterday (Oct. 23) to face a drunk driving charge stemming from her Sept. 12 arrest. ABC reports that a breathalyzer test showed she had a blood-alcohol level that was more than double the state's legal limit, but Lohan's attorney maintains the 51-year-old doesn't have a substance abuse problem. In fact, he says, it's all the paparazzi's fault.

A court-ordered evaluation, obtained by ABC and New York Post's Page Six, explains the claim. It reads:

There is no indication that Dina suffers from alcohol abuse or dependency. Her record is remarkably unblemished. Therefore, treatment is not being recommended. It is [my] professional opinion that the circumstances leading to Dina's arrest were largely impacted from the ongoing daily stresses caused by the paparazzi, the media attention and distorted tabloid character profiles.

After meeting Dina and her family and witnessing the care, compassion and concern shared between family members, it is my hope that the courts will take the circumstances and challenges of Dina's lifestyle under consideration in prosecuting this case.

Last month, Lohan entered a not guilty plea to the charges. She was released without bail but had her license suspended.

The lawyer pushing this line of defense is Mark Heller, whom Dina's daughter, Lindsay, fired over a previous shoplifting case, adds TMZ.

A request for comment made to Dina's rep was not immediately answered.
