Man Pulls Gun At Kid's Party After Cake Runs Out

The host of a kid's birthday party wouldn't let his children eat cake -- so Joseph Hayes threatened to make her eat lead, according to police.

The Memphis, Tenn. man is behind bars after allegedly drawing a gun during a child's birthday party after his own kids arrived too late for cake and ice cream on June 4.

By the time Hayes, 48, arrived at the party with his kids, other revelers had already finished the cake, according to WREG.com.

"Y'all didn’t save my kids no damn ice cream and cake," Hayes shouted at the host, according to a police affidavit obtained by the Commercial Appeal.

Hayes left the party and returned with a handgun he had retrieved from his apartment, then confronted the host and lifted his shirt to reveal his weapon, police claim.

"I ain't scared to go to jail, just take care of my kids," he allegedly stated.

The suspect has been charged with aggravated assault and is being held on $30,000 bond, according to inmate information posted on the Shelby County Sheriff's Office website.

Hayes reportedly told authorities that he wasn't carrying a gun, but had instead stuck an item that looked like a firearm into the waistband of his pants.
