Lindsay Lohan, Pitbull Lawsuit Thrown Out By Judge

Turns out Lindsay Lohan is no match for a Pitbull.

In 2011, Lohan sued rapper Pitbull for a lyric about her in his hit single "Give Me Everything," written by Ne-Yo and Afrojack. She claimed the lyric was "disparaging and defamatory" and sued under New York's Civil Rights Law.

The actress claimed in her suit that the lyrics "Hustlers move aside, so I'm tiptoein', to keep flowin'/ I got it locked up like Lindsay Lohan" were "destined to do irreparable harm" to her reputation and caused her "emotional distress," according to The Wrap.

But on Thursday, a New York federal judge threw out Lohan's lawsuit against Pitbull, TMZ reported.

Pitbull's song is a work of art and is thus protected under the First Amendment, according to TMZ. The judge also dismissed the "Canyons" actress's claim that the song caused her "emotional distress."

"Even if the defendants used plaintiff's name in one line of the Song without her consent, such conduct is insufficient to meet the threshold for extreme and outrageous conduct necessary to sustain a claim for intentional infliction of emotional distress," the judge ruled, according to The Wrap.

Pitbull's attorneys wanted to sanction Lohan for the frivolous lawsuit, but the judge decided a sanction wasn't warranted, The Hollywood Reporter notes.

The 32-year-old rapper is said to be "very pleased" with the outcome of the case.

"This will further solidify the rights of artists to express themselves in song," his lawyer said in a statement to E! News. "He felt it was very important to address this head on to protect his right and the rights of other artist. He decided to fight this."
