Jury Convicts Burglar Who Shot -- And Later Sued -- 90-year-old

NOVATO, Calif. — A Marin County jury has convicted a burglar of two counts of attempted murder for breaking into the home of a 90-year-old man and shooting him in the jaw.

The 31-year-old Cutrufelli now faces the possibility of life in prison. No sentencing date has been set.

Authorities say Cutrufelli, of Novato, was holding Jay Leone at gunpoint in January while searching Leone's Greenbrae home for valuables. Leone freed himself, got his handgun, and the two men exchanged fire.

Leone was shot in the face and Cutrufelli was shot three times.

Cutrufelli recently filed a lawsuit claiming the homeowner negligently shot him, and caused him "great bodily injury, and other financial damage, including loss of Mr. Cutrufelli's home, and also the dissolution of Mr. Cutrufelli's marriage," according to SourceNewspapers.com.

Before the verdict, Cutrufelli's lawyer, Sanford Troy, told reporters that if his client is convicted, he might suggest dropping the suit.
