JÉRUSALEM - Le groupe militant Hamas a enlevé, torturé et tué des Palestiniens pendant la guerre dans la bande de Gaza l'an dernier, ce qui constitue dans plusieurs cas des crimes de guerre, a affirmé mercredi Amnistie internationale.

Ces allégations sont détaillées dans un rapport rendu public mercredi.

Le groupe de défense des droits de la personne affirme que 23 Palestiniens ont été abattus et des dizaines d'autres arrêtés et torturés par le Hamas, qui gouverne la bande de Gaza. Les victimes étaient des rivaux politiques du Hamas — y compris des membres du parti Fatah du président Mahmoud Abbas — ou des individus soupçonnés de collaborer avec Israël.

Six de ces collaborateurs présumés ont ainsi été exécutés publiquement le 22 août devant une foule de plusieurs centaines de personnes qui comprenait de nombreux enfants, à l'extérieur de la mosquée al-Omari. Chaque homme aurait été abattu d'une balle à la tête, puis criblé de balles de fusil d'assaut AK-47.

Un représentant d'Amnistie, Philip Luther, affirme que le Hamas a profité du conflit pour régler ses comptes avec ses adversaires en commettant une série de gestes qui, dans certains cas, constituent des crimes de guerre.

Le rapport ajoute que 16 des personnes tuées par le Hamas étaient déjà détenues par le groupe militant au début des hostilités. Plusieurs d'entre elles étaient en attente de leur sentence, au terme de procès qualifiés d'injustes par Amnistie. Certains accusés ont affirmé avoir été contraints de se confesser sous la torture.

Amnistie affirme que plusieurs victimes ont été détenues et torturées par le Hamas dans une clinique médicale abandonnée du principal hôpital de la ville de Gaza.

«Les forces du Hamas ont témoigné d'un mépris envers les règles fondamentales du droit humanitaire international, a dit M. Luther. La torture et le traitement cruel de détenus pendant un conflit représentent un crime de guerre. Les exécutions extrajudiciaires sont aussi un crime de guerre.»
