Bill Cosby demande à la plaignante qui l'accuse d'agression sexuelle de rembourser le montant qu'il lui a versé dans le cadre d'une entente à l'amiable conclue quelques années plus tôt.

Dans une poursuite pour rupture de contrat déposée jeudi, M. Cosby accuse Andrea Constand d'avoir collaboré "volontairement" avec la police qui avait rouvert une enquête sur l'affaire, ce qui a mené à l'arrestation de l'ancienne vedette de la télévision américaine, l'année dernière.

La poursuite allègue que Mme Constand n'avait pas l'obligation de collaborer avec les autorités de la Pennsylvanie puisqu'elle habite le Canada. L'entrevue que sa mère et elle ont donnée à la police était "volontaire" et a violé les termes de l'entente, est-il écrit dans le document.

Les avocats de M. Cosby plaident que Andrea Constand a fait fi de son engagement de ne rien révéler sur les événements en vertu de l'entente, puisqu'elle n'était pas obligée de parler aux autorités.

M. Cosby est accusé d'avoir agressé sexuellement Mme Constand dans sa résidence en banlieue de Philadelphie, en 2004. S'il est reconnu coupable, il pourrait écoper d'une peine de prison de dix ans.

Il n'a pas encore livré son plaidoyer, mais ses avocats ont fait savoir qu'ils avaient l'intention de rétablir sa réputation.

La poursuite de M. Cosby mentionne également la mère et les avocats de la plaignante parce qu'ils auraient collaboré avec les autorités du comté de Montgomery, l'année dernière. Ils auraient aussi invité les médias et parlé publiquement de l'affaire.

Les avocats d'Andrea Constand ont assuré qu'il y avait une clause dans l'entente leur permettant de parler aux autorités.

Cette poursuite est la dernière contre-attaque de Bill Cosby, 78 ans, face aux plaintes de douzaines de femmes qui l'accusent de les avoir droguées et violées. Il a déjà déposé des poursuites en diffamation contre des plaignantes de Springfield, au Massachusetts, et Los Angeles.

La poursuite contre Andrea Constand lui ordonne de rembourser le montant toujours secret d'une entente à l'amiable conclue en 2006. Il réclame aussi des dommages-intérêts de la mère de Mme Constand, de ses deux avocats et de la société mère du "National Enquirer", qui a publié plusieurs histoires sur le sujet.

M. Cosby a souffert de "de torts importants et irréparables" qui devraient être compensés, est-il écrit.

L'avocate de Mme Constand, Dolores Troiani, n'a pas voulu commenter la nouvelle, mais elle a signifié son intention de se défendre "publiquement" contre ces allégations.
