TORONTO - Le sort du maire de Toronto Rob Ford était entre les mains de trois juges lundi après une journée d'arguments plutôt techniques pour et contre une décision judiciaire disant qu'il devrait être destitué pour conflits d'intérêts.

Son avocat Alan Lenczner a notamment plaidé à la Cour divisionnaire que M. Ford était un politicien ouvert et honnête qui a été ordonné de quitter son emploi par un juge qui avait mal interprété la loi.

Les opposants du maire ont pour leur part fait valoir que le maire avait délibérément bafoué les règles sur les conflits d'intérêts, et que la décision du juge de première devait être considérée avec révérence aussi longtemps qu'elle était raisonnable.

M. Lenczner a appelé à la Cour divisionnaire de renverser la décision de destituer le maire Ford, disant qu'il n'y avait jamais eu de cause contre le maire.

Ce dernier n'a jamais réalisé de gains financiers en demandant du financement pour sa fondation de football en utilisant du papier avec l'en-tête de la Ville. Et il a été clair lorsqu'il a pris la parole lors d'un vote du conseil municipal, disant qu'il essayait seulement de venir en aide à des jeunes désavantagés.

«Il a été parfaitement clair et honnête», a argumenté M. Lenczner.

En novembre, le juge Charles Hackland, de la Cour supérieure de l'Ontario, a ordonné que M. Ford soit chassé de la mairie en raison de sa participation à ce vote du conseil municipal, car il avait des intérêts personnels dans le dossier.

En guise de réplique, Me Lenczner a souligné lundi que le maire avait participé à ce vote parce qu'il croyait qu'il n'avait rien fait de mal.

«Ce n'est pas le montant d'argent qui le motive à parler et à voter, c'est le principe de la chose», a-t-il plaidé aux trois juges, dans une salle d'audience remplie à craquer.

Il a argumenté qu'on ne pouvait s'attendre à ce que M. Ford comprenne les complications légales de l'affaire, puisque «M. Ford est diplômé d'une école secondaire».

Les avocats pour le résidant torontois Paul Magder, qui avait porté la cause devant la justice, ont argumenté que la décision du juge Hackland devait rester.

L'un d'eux, Clayton Ruby, a rejeté l'argument que M. Ford avait commis une erreur de jugement de bonne foi.

Il a argumenté que le maire avait refusé de coopérer avec le commissaire à l'intégrité de la ville, qui avait averti M. Ford de ne pas participer au vote, mais le juge Then a refusé cet argument, disant que chaque fois qu'il a été averti qu'il y avait un conflit d'intérêt, M. Ford avait pris l'avertissement en considération.

Il a ajouté que M. Ford avait arrêté d'utiliser du papier à en-tête de la ville pour solliciter des dons pour la fondation de football et qu'il avait écrit aux donateurs pour savoir s'il pouvait leur remettre l'argent.

S'il perd son appel, M. Ford a indiqué qu'il se présenterait dans une élection partielle si le conseil municipal décidait d'en convoquer une. Le conseil pourrait également nommer quelqu'un au poste de maire plutôt que de convoquer une élection partielle.

Les trois juges de la cour divisionnaire rendront leur décision plus tard.
