Si au Québec n'importe qui peut devenir inspecteur en bâtiment, l'Ontario s'apprête pour sa part à réglementer cette industrie.

L’acquisition d’une maison est un achat important dans une vie. Les gens font donc appel à un inspecteur en bâtiment avant de prendre une décision. Toutefois, comment savoir si l’inspecteur que vous avez choisi est qualifié?

« N’importe qui peut s’autoproclamer inspecteur en bâtiment », déplore Pascal Parent, président de l’Association des inspecteurs en bâtiments du Québec (AIBQ). Il suffit de se procurer des cartes professionnelles et de créer un site web, explique M. Parent.

Au Québec, la profession n’est pas encadrée, la formation n’est pas obligatoire et aucun permis n’est requis. Trop souvent, les inspecteurs ne sont même pas assurés.

La « tour des fous »

L’AIBQ et l’Association nationale des inspecteurs et experts en bâtiments (ANIEB) militent activement depuis 14 ans pour un encadrement législatif de la profession.

Près d’un demi-million de dollars en honoraires de lobbyiste plus tard, les deux associations se désolent du manque de volonté politique.

L’AIBQ accuse Québec d’immobilisme. « Le gouvernement ne se responsabilise pas face à ça », souligne Pascal Parent. Pour M. Parent, la situation est d’autant plus frustrante quand il compare l’attitude du gouvernement québécois à celle de nos voisins ontariens.

Réglementer la profession en Ontario

Devant le nombre et l’ampleur des plaintes d'acheteurs sur l'inspection en bâtiment, l’Ontario a décidé de faire de la protection des consommateurs l’une de ses priorités.

Celle qui était jusqu'au 12 janvier 2017 la ministre ontarienne des Services gouvernementaux et des Services aux consommateurs, Marie-France Lalonde, a déposé cet automne un projet de loi visant à réglementer le secteur de l’inspection pré-achat.

Le projet de loi 59, s’il est adopté, mettra en place une autorité administrative indépendante, qui aura le mandat d’uniformiser la formation, de rédiger un code de déontologie, de délivrer les permis et d’établir un rapport type.

Si le projet de loi est adopté, l’Ontario deviendrait la troisième province canadienne à légiférer pour un encadrement, après la Colombie-Britannique en 2009 et l’Alberta en 2011.

Conseils pour choisir un bon inspecteur

Il est recommandé de privilégier un membre d’un ordre professionnel (par exemple, des technologues, des évaluateurs agréés, des architectes ou des ingénieurs). Les membres des ordres sont assurés, sont régis par des normes et détiennent une formation dans le domaine.

On peut également choisir un inspecteur membre d’une association reconnue (ANIEB, AIBQ, Internachi), car leurs membres détiennent une assurance et doivent suivre de la formation continue. Dans ce cas, Pascal Parent, président de l'AIBQ, recommande d’appeler directement l’association pour vérifier l’adhésion, car il arrive fréquemment que des inspecteurs utilisent leur logo sans en être membres.

  • Faites-vous partie d’un ordre professionnel?

  • Faites-vous partie d’une association reconnue?

  • Détenez-vous une assurance erreur et omission?

  • Depuis combien d’années faites-vous de l’inspection?

  • Quelle est votre formation (programme de formation continue)?

  • Travaillez-vous selon des normes de pratique reconnues?

  • Avez-vous déjà été poursuivi dans le passé?
