De nouvelles accusations ont été portées contre la MMA et sept personnes en vertu de la Loi sur la sécurité ferroviaire et de la Loi sur les pêches dans l'affaire du déraillement tragique de Lac-Mégantic. L'enquête menée par Transports Canada a conclu que le nombre de freins à main serrés pour immobiliser le train était insuffisant et que la résistance des freins à main au déplacement du train n'avait pas été vérifiée convenablement.

L'enquête d'Environnement Canada en vertu de la Loi sur les pêches porte sur « la violation de l'interdiction d'immerger ou de rejeter une substance nocive - ou d'en permettre l'immersion ou le rejet - dans des eaux où vivent des poissons survenue lorsque l'accident a provoqué le déversement de pétrole brut à proximité du lac Mégantic et de la rivière Chaudière », peut-on lire dans un communiqué émis plus tôt lundi matin.

Ces accusations seraient déposées à la fois au Canada et aux États-Unis. Les accusés devront comparaître devant le tribunal à Lac-Mégantic en novembre 2015 et c'est le tribunal qui déterminera les responsabilités. S'ils sont reconnus coupables, les individus pourraient écoper d'une amende allant jusqu'à 50 000 $ et d'une peine de prison par accusation. L'entreprise, de son côté, pourrait devoir payer jusqu'à 1 million de dollars.

Concernant l'enquête d'Environnement Canada, ce sont les huit mêmes personnes. Une neuvième personne sera accusée, mais son nom n'a pas été dévoilé à l'heure actuelle.

En mai 2014, trois employés de la MMA avaient été accusés. Thomas Harding, Jean Demaître, Richard Labrie et la MMA font face à 47 chefs d'accusation de négligence criminelle ayant causé la mort.

Tom Harding était l'ingénieur de la locomotive du convoi qui a déraillé et explosé au coeur de Lac-Mégantic. Quelques jours après le drame, le patron de la MMA, Edward Buckhardt, l'avait accusé d'être en partie responsable de la tragédie et l'avait suspendu. M. Buckhardt soutenait que M. Harding n'avait pas appliqué tous les freins à main qu'il aurait dû actionner. Richard Labrie était le contrôleur ferroviaire, alors que M. Demaître était contrôleur de l'exploitation.

Dans la nuit du 6 juillet 2013, un train de 72 wagons a dérailléau centre-ville de Lac-Mégantic causant la mort de 47 personnes. Le train appartenait à l'entreprise Montreal Maine & Atlantic rail compagny, qui a fait faillite depuis.
