Garder les loyers abordables, une cession de bail à la fois

L'idée est née entre amis en 2009 : créer une page sur Facebook pour que les bons logements, à bon prix, restent dans leur cercle. Quelques années plus tard, ce sont plus de 9000 personnes qui sont membres du groupe « J'te cède mon bail ». Regard sur une initiative citoyenne pour trouver un logement abordable et contrecarrer les augmentations importantes de loyers.

Augmenter substantiellement le prix d'un appartement lorsqu'il revient sur le marché semble être une pratique courante, comme le révélait notre enquête sur les annonces publiées sur Kijiji.

La page « J'te cède mon bail » accepte seulement les cessions de bail, une façon de s'assurer qu'un logement ne subira pas une hausse majeure de prix.

Lili Émond, cofondatrice du groupe, se rappelle avoir été prise de court par la popularité de leur groupe. « Mon ami Joachim Lupens qui a fondé le groupe ne s'attendait pas à ça. On pensait une centaine maximum de copains qui adhèrent ».

Des dizaines, puis des centaines d'utilisateurs se sont joints au groupe au fil du temps. Des bénévoles ont dû être recrutés pour gérer les annonces. Aujourd'hui, il faut demander une autorisation pour joindre le groupe.

Le groupe a aussi une autre mission : informer les membres de leurs droits et des règles qui régissent le logement.

« Exercer la cession de bail, c'est exercer un droit qu'on a. On n'en a pas beaucoup, mais celui-là en est-un », explique Lili Émond.

Des règles strictes

Lorsqu'on arrive sur la page du groupe, une longue liste de règles mises en évidence pour bien comprendre quel genre d'annonces pourront être publiées. Des prix élevés ne sont pas tolérés.

Voici des exemples de prix suggérés :

- Studio = 500 $ ( jusqu'à 600 $ si chauffé et/ou meublé)

- 3 1/2 =700 $ ( jusqu'à 800 $ si chauffé et/ou meublé)

- 4 1/2 = 900 $ (800 $ pour une seule chambre fermée ou pièce double fermée)

- 5 1/2 = 1000 $

- 6 1/2 = 1100 $ (6 1/2 ou + avec sous-sol fini (chambre supplémentaire)

Des internautes tentent parfois d'afficher des appartements beaucoup plus dispendieux.

« Certains ne comprennent pas, parce qu'ils se demandent : pourquoi ne pas freiner aussi la hausse de ces logements-là, qui sont déjà plus chers? », indique Lili Émond.

Les administrateurs préfèrent concentrer leurs efforts sur des logements abordables pour tous.

Pour Martin Blanchard, organisateur communautaire au Comité logement La Petite-Patrie, l'existence d'un groupe comme « J'te cède mon bail » est révélateur.

« Ça montre qu'il y a réellement du monde qui est prêt à se mobiliser pour avoir un loyer pas cher. Mais il faut aller changer les lois, il faut avoir un vrai contrôle des loyers. Les regroupements de comités de logement demandent à avoir un registre des loyers. »

Pourquoi un registre? Pour que les locataires trouvent rapidement le prix payé pour la personne qui était là avant. Le propriétaire est tenu de l'inscrire sur le bail à signer, mais l'information est parfois absente. Et il est quasiment impossible de vérifier si elle est véridique. Si le nouveau locataire trouve le prix trop élevé, c'est à lui de le contester devant la Régie du logement du Québec.

En 2013-2014, 131 plaintes de ce type ont été déposées par un locataire.

Quel avenir pour « J'te cède mon bail » ?

Un passage, peut-être, hors des murs de Facebook. « On travaille sur un site web. On voudrait le rendre plus accessible à tout le monde, le groupe, et qu'on a moins de travail [pour automatiser les annonces]. Quotidiennement, il faut des membres et trier les annonces qui nous sont proposées », explique Lili Émond.

Un travail qui est pour l'instant est fait bénévolement.
