With all the hoopla about Intelligent Design, here’s a hypothetical. Suppose the Old Testament read slightly differently. Suppose Genesis said that on the third day God caused lightning to flash and create the smallest living things, and some of those became plants. And on the fifth day some of the smallest things became larger, more complex things, like birds and whales. And on the sixth day some became even more complex creatures, including cattle and human beings.

Suppose, in other words, that the Genesis account was a brief description of evolution. Would the ACLU argue that it was unconstitutional to teach evolution in public schools?
